DEMOCRACY FORWARD ACT (DCA)

Title: Democracy Forward Act — Restoring and Defending Article 1 in Congress - to reclaim Congress from Executive Overreach

Purpose & Background – Executive overreach has usurped Congress’s Article I powers—through unchecked executive orders, illegal impoundment, weaponization of federal agencies, and the dangerous misuse of the Insurrection Act to threaten deployment of the military against peaceful American citizens exercising their First Amendment rights. The Democracy Forward Act reclaims that stolen authority with four unbreakable pillars and one urgent call to action:

  1. Congressional veto of major executive orders

  2. A permanent, total ban on impoundment

  3. Full statutory independence for the Department of Justice, FBI, Department of Health and Human Services, and other critical institutions

  4. Closing the 217-year-old Insurrection Act loophole by mandating emergency federal judicial review before any President can ever deploy federal troops or federalized National Guard against the American people, and by permanently prohibiting the use of the military to suppress peaceful assembly, protest, petition, or any other exercise of First Amendment rights

Petition to Congress: The Democracy Forward Act is backed by a nationwide citizens’ preemptive movement demanding that Congress immediately impeach and remove both the President and Vice President and Vice President for violating sacred constitutional lines, and then elect a new Speaker truly committed to defending We the People against executive tyranny.

 

It is the only constitutional remedy We the People have when the President and Vice President break their sacred oath to defend the Constitution of the United States. Nothing else is permissible under our Constitution.

DCA Provisions and/or Pillars

Section 1:

Executive Order Veto

Any Presidential or Administration non-emergency executive order affecting 5M+ people or $5B+ requires Congressional review and approval 36 hours before signature. If a majority of Congress does not approve of the Executive Order, the Executive Order is considered vetoed by Congress. Any attempts by the President or any appointee of the President of Administration to implement the Executive Order signed or unsigned will be brought to the Congressional Oversight Committees for further action.  The Executive branch may issue an emergency Executive Order; in which Congress must approve or veto the Executive Order with in 30 days of having been signed publicly.  Any overreach of this manner may lead to impeachment.

Section 2:

Impoundment Ban

No President or member of his/her administration may withhold Congressionally approved funds.  
Automatic disbursement upon appropriation. Any attempts to use such approved funds in any manner other than earmarked by Congress shall be addressed by the Congressional Oversight Committees and any overreach in this manner may lead to impeachment.

Section 3:

Institutional Independence

The President which within his/her right may Nominate and seek Senate confirmation for institutional heads. For example, heads of DOJ, FBI, HHS, CDC, EPA will serve 10-year fixed terms. Congressional approval for removal must achieve a (2/3 vote. No political appointees in career roles.  At least annual congressional oversight hearings must be conducted if Congress believes the President is interfering with the independence of these institutions. 

Section 4:

Closing the dangerous Insurrection Act loophole

The Democracy Forward Act closes the dangerous Insurrection Act loophole by requiring emergency federal court approval before the President can ever deploy federal troops or federalized National Guard against the American people, and by permanently prohibiting any use of the military to suppress peaceful protests, assemblies, petitions, or other First Amendment-protected activities. No President will ever again be allowed to turn the Armed Forces against ‘We the People’ exercising our sacred rights to speak, assemble, and demand redress of grievances.​​​​​​​​​​​​​​
