Title: Immigration Reform Act — Keep the Baby, Drain the Bathwater
​Purpose & Background
Immigration & Slavery built America—from pre-colonial waves of English, French, and Spanish settlers to today. This journey is historically paved with tragedy, yet we would not be the world’s greatest economy and democracy without immigration.

Today, over 12 million undocumented workers and their families contribute $350 billion to the GDP and $100 billion in taxes annually—with little to no benefits, yet they thrive and are often sought out by employers for work that is difficult to hire.

Mass deportation is appalling—especially the violence, denial of due process, and illegal searches and seizures.
​​
We reform, not destroy. Over the past 250 years we have passed many immigration reforms but have never implemented counterproductive mass deportation policies that we have today.

Keep the baby (economic power) — drain the bathwater (violent crime, fraud, grand theft).

Section 1:
Refocus ICE & CBP to stop the violations of the constitution
Prioritize deportation of persons convicted of violent crime & grand theft. Prosecute any federal policing agency officers who do not follow standard policing protocols, such as self-identification, deescalation, probable cause investigations, and violating due process adjudication alongside judicial immigration courts.
Section 2:
Implement 2-year Self-Sustainabilty Visa
Self-sustaining visa (Red Card) - Work allowed.
Within 90 days of implementing this bill into law, every undocumented person, must self-report to immigration for review and issuance of a Red Card.

After a 2-year period, must prove to the court's - household income > 150% state poverty line and not a recent (less than 6 months) undocumented immigrant - though proof of residency.
If so, an individual is then eligible for resident visa (Green Card) and if they so choose a path to → citizenship. (Note Section 4 Provision). All others will be deported after due process.
Anyone recently overstaying or entering improperly, will not be eligible for any visa for a 10-year period (no exceptions). However, documented self-deportations, will be viewed favorably and not be used to deny any future visa applications.
Section 3:
Visa - Family Unit Rule
Minors, elderly, dependents are included in household self-sustainability evaluation. If the immigrant does not qualify, families will be given 60 days to arrange for the economic and emotional impact - then proceed with exiting the country. ​​​​​​​​

Upon being approved to covert to resident visa, the waiting period to apply for citizenship will be twice the wait of an immigrant that did not "cut in line" by overstaying any visa or improperly entering the country and bypassing immigration and customs & border protection check points.​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​

Require and order the U.S. State Department and all US Embassies to receive and prioritize every person able to document that they were illegally deported and accelerated that every such individual who is outside the country be brought home immediately to their initial detention center or location of illegal arrest at the expense of the government. It also orders the US State Department to give them neutral advice and not implead their reentry. Any employees of the State Department doing so, will be appropriately disciplined including dismissal.
For US Citizens, they will be issued valid proof of citizenship - including expedited US Passports at no cost. They will also qualify for expedited escort back home. They will also be eligible for reasonable compensation for any physical, economic, or emotional distress compensation, by filing a case in the courts. The courts will be able to determine the merits of the case and asked to judge in favor of the citizen. Those with legal residency, will have their visa expedited and reissued at no cost. Like a citizen they also qualify to file a distress case. Those with expired or no visa, will be issued a 6-month temporary "temporarily home" visa, to seek documented entry, and legal representation for the immigration courts to determine their path. The US State Department will have obligation to get them home, just over the border. They also will have no obligation to assist with legal representation once inside the US border. They will not be eligible to file a distress claim but can file a claim for allegedly having their constitutional rights violated.​

Any all costs associated with this effort, shall be funded by the already appropriated budget to the Department of Homeland Security, being that they were responsible for the illegal mass and individual deportations.

If any agency enforcement or arresting agency, like ICE or ICBP can prove the individual was legally deported via the immigration courts, the US State Department may cease any and all assistance to the individual.​​​​​​​
